Standard Terms and Conditions of Service Agreement

I will be billed monthly, quarterly or annually on a calendar basis. Once installed, the software is your responsibility, in that we have no control who uses your computer or may change settings in your software. We want to help make sure you can enjoy the Internet and it’s many resources. However, in some cases where there has been repeated damage or unwarranted changes made, there may be a charge for reinstallation of your software. In these cases the charge would be $15.00 for in house fixes (at NCI Data.com) or $25.00 if we need to make a house call (at your house).

If NCI Data.com does not receive my payment by 5 days after the due date, my account will be terminated. Termination does not remove my responsibility to pay all fees due at time of cancellation. I agree to pay the monthly fee for the month in which my account was cancelled, plus all collection and legal costs incurred by NCI Data.com. NCI Data.com reserves the right to cancel this service for any reason it deems necessary and to reimburse me for any unused fees on a pro-rated basis.

NCI Data.com makes no warranties of any kind, whether expressed or implied, including any warranty of merchantability or fines of this service for a particular purpose. NCI Data.com disclaims all responsibility for any damages suffered by me including, but not limited to, loss of any data from delays, non-deliveries, or service interruptions caused by NCI Data.com’s own negligence or my errors and/or omissions. NCI Data.com shall have no liability whatsoever for consequential damages from any failure of the system.

NCI Data.com services may only be used for lawful purposes. Transmission or re-distribution of any material in violation of any United States or State regulation, including copyright laws are prohibited. I agree to indemnify and hold harmless NCI Data.com from any liabilities and claims resulting from my use of this service that damages any party or me. Use of any information obtained via this service is at my own risk. NCI Data.com specifically denies and disclaims any responsibility for the accuracy or quality of information obtained through this service.

I will notify NCI Data.com of any changes in account information, such as change in address or phone number.

I am responsible for the manner in which my account in used. I may allow others to use it, from my computer only, bearing in mind that under terms of this agreement, I am responsible for what they do.

Disk storage will be as limited by the service provider to NCI Data.com. Excess storage is not permitted on user drives.

I may cancel my NCI Data.com account effective at the end of the current month. I am responsible for any fees incurred up to the date of cancellation of this service and for the remaining monthly fee for the month in which I cancel my account.

I agree to use this Internet service in a moderate time scale acknowledging that it is a shared resource with other NCI Data.com customers. I also understand that NCI Data.com’s general rule for access is three hours on, one hour off and that I may be disconnected from the server as a result of prolonged use beyond this general rule.

These terms and conditions supersede all previous representations, understandings or agreements and shall prevail, regardless of any variance from terms and conditions for any order submitted. These terms and conditions are subject to change without notice. Changes will be announced to all affected customers business hours at the offices of NCI Data.com located at 320 Emery Street, Omak. Continued usage of my account after a new policy has gone into effect constitutes acceptance of that policy. NCI Data.com encourages me to regularly read e-mail correspondence to me for vital connection information.
